Mineral Prospecting Right and Mineral Exploitation Right Assignment should be Granted through Bidding


Environmentally  sensitive  areas  and  areas  where  the environment quality standards is not up to the government regulations, where new exploration and mining rights may be granted in accordance with the laws and regulations as well as government policies.


Mineral resources with syngenetic and associated minerals with many varieties of constituents and high technological demand for synthetic utilization
Other cases as defined in the plan for mineral resources.


The transfer of mineral prospecting rights and mineral exploitation rights refers to the actions to transfer mineral prospecting rights and mineral exploitation rights by the holders of those rights according to law, covering the sale, evaluation and investment, co-operation, reorganization and reform etc. of those rights. The lease and hypothecation of mineral prospecting rights and mineral exploitation rights shall be managed according to the mineral prospecting rights and mineral exploitation rights assignment conditions and procedures and shall be examined and approved by the original license issuer.


The two parties involved should apply for the transfer of mineral prospecting rights and mineral exploitation rights (for all types of transfer) from the registration authority and go through  the  registration  revision  formalities  after the application  is  examined  and  approved.   The  mineral exploitation  rights  holder  shall  not  transfer  mineral exploitation rights to any other party for mining or operation through subcontracting or any other method.
